PROVIDENCE, R.I. (AP) – Gov. Lincoln Chafee’s office inadvertently turned over a privileged document to lawyers for one of the defendants in the 38 Studios case that they now want destroyed.
The attorney, Anita Flax, said in court Friday she accidentally turned over a memorandum to Wells Fargo, one of 14 defendants in the litigation. The memorandum was from attorneys advising the governor’s staff about 38 Studios in May 2012 as the company was imploding.
Wells Fargo attorney Thomas Holt argues the defendants are entitled to the document.
Flax is asking Judge Michael Silverstein to order that all copies of the document be destroyed.
The former Economic Development Corp. sued the ex-Red Sox pitcher and others after 38 Studios went bankrupt. The EDC approved a $75 million loan guarantee for the company.
